Shipping Policy

This policy governs the shipping of all products, including but not limited to, firearms, ammunition, parts, accessories, and other defense-related articles. Compliance with all Federal, State, and Local laws is the sole responsibility of the customer and the recipient Federal Firearms License (FFL) holder.

1. General Policy Statement - Returns and Refunds

FINAL SALE POLICY: All sales are considered final upon successful transfer of the firearm to the customer.

We urge all customers to inspect their items thoroughly before completing the transfer. Due to the legal nature of firearm transfers, once a firearm leaves our premises under the customer's legal possession (after the Form 4473 and background check are complete), it is considered a used firearm and cannot be returned or exchanged except in the specific circumstances outlined below.

2. Firearm-Specific Exceptions & Fees

  • Shipping Costs: Non-refundable (both to the FFL and return shipping)
Applies if a firearm shipped to a third-party FFL is refused by the customer for reasons other than verifiable damage.
Manufacturer Defect (After Transfer) NO Refund or Exchange by HavocTech Armory LLC N/A Once transferred, any and all defects, malfunctions, or warranty claims are the sole responsibility of the manufacturer. We will provide manufacturer contact information for warranty service/repair.
Used Firearms All Sales Are Final - NO Returns, NO Refunds, NO Exchanges N/A Used firearms are sold "As-Is" with no warranty expressed or implied from HavocTech Armory LLC.

3. Non-Firearm Products (Accessories, Ammo, Components)

Ammunition, Reloading Components, Cleaning Solvents/Liquids

ALL SALES ARE FINAL - NO Returns, NO Exchanges. (For safety and liability reasons)

Accessories/Apparel (Unused)

May be returned within 30 days of purchase for a refund or exchange, provided the item is:

Shipping Costs: The customer is responsible for return shipping costs unless the item was damaged or incorrect upon receipt.

4. Special Orders and Layaways

Special Orders

All special or custom orders require a non-refundable 50% deposit or be paid in full at the time of order.

If canceled, the deposit is forfeited or a 25% cancellation fee applies to the total purchase price, whichever is greater.

Layaways

All payments made toward a layaway are non-refundable if the layaway is forfeited or canceled after 30 days.

A cancellation fee will be charged on all canceled layaways in accordance with the layaway agreement terms.

5. Critical Steps for Firearm Transfer (Iron Clad Protection)

CRITICAL CUSTOMER OBLIGATION: INSPECT BEFORE YOU ACCEPT

Do not sign the ATF Form 4473 or take physical possession until you have thoroughly inspected the firearm for any cosmetic or functional defects, ensuring it is the correct model, caliber, and configuration.

Once the firearm is transferred into your possession and leaves our store, it is legally considered used. At this point, HavocTech Armory LLC can no longer accept it for return or refund. All post-transfer issues are covered solely by the manufacturer's warranty.

6. Florida & Hillsborough County Compliance

State and Local Preemption

Florida law preempts local governments from regulating the sale of firearms. While Hillsborough County has specific local ordinances, your core refund policy is a matter of business contract. All policies comply with established State and Federal law.

Waiting Periods

Florida State Law

Florida requires a 3-day waiting period for firearm purchases (waived for concealed carry weapon permit holders).

Hillsborough County Ordinance

Hillsborough County requires a 5-day waiting period (120 hours excluding weekends and legal holidays) between the time of sale and the time of delivery of any firearm.

Example: For a handgun transfer initiated on Monday, January 6, 2025:

  • Purchase Confirmation: Receipt of purchase establishes the start of the waiting period (January 6, 2025)
  • Background Check: NICS background check completed on January 6, 2025
  • Waiting Period Calculation: 5-day waiting period covers January 7, 8, 9, 10, and 13, 2025 (excluding weekends)
  • Pickup Eligibility: Earliest pickup is Monday, January 13, 2025 (assuming background check approval)

Background Check Failure

Non-Refundable Fees: If a buyer is denied by the background check system (NICS/FDLE), the fee associated with the background check and the restocking fee (20%) are non-refundable. A denied buyer is legally prohibited from possessing the firearm, and the customer is responsible for all associated fees.

Restocking Fees

Restocking fees are necessary in the firearms industry because once a firearm leaves our inventory for transfer, it must be documented and re-transferred if refused, and cannot be resold as new. Our restocking fees reflect industry standards and the administrative burden of reversing firearm transactions.

Firearms and Receivers (Serialized Items)

FFL Requirement: All complete firearms, serialized frames, receivers, and other items defined as a "firearm" under the Gun Control Act of 1968 must be shipped to a valid Federal Firearms License (FFL) holder.

11. Lost, Damaged, or Stolen Packages

Damages

If your order arrives damaged, please contact us immediately at service@havoctech.com with photos of the damage and packaging.

Lost/Stolen

We are not responsible for packages that are lost or stolen after the carrier confirms delivery to the provided address (and FFL, where applicable). We recommend adding optional Shipping Insurance at checkout to cover this risk.

Carrier Claims

We will assist the customer in filing a claim with the carrier for insured packages that are lost in transit. Please note that an investigation may take 7 to 14 business days before a resolution is provided.
