Shipping Policy

This policy governs the shipping of all products, including but not limited to, firearms, ammunition, parts, accessories, and other defense-related articles. Compliance with all Federal, State, and Local laws is the sole responsibility of the customer and the recipient Federal Firearms License (FFL) holder.
1. General Policy Statement - Returns and Refunds
We urge all customers to inspect their items thoroughly before completing the transfer. Due to the legal nature of firearm transfers, once a firearm leaves our premises under the customer's legal possession (after the Form 4473 and background check are complete), it is considered a used firearm and cannot be returned or exchanged except in the specific circumstances outlined below.

3. Non-Firearm Products (Accessories, Ammo, Components)
Ammunition, Reloading Components, Cleaning Solvents/Liquids
Accessories/Apparel (Unused)
May be returned within 30 days of purchase for a refund or exchange, provided the item is:
- New and unused
- In original, unopened packaging
- Accompanied by the original receipt
Shipping Costs: The customer is responsible for return shipping costs unless the item was damaged or incorrect upon receipt.
4. Special Orders and Layaways
Special Orders
All special or custom orders require a non-refundable 50% deposit or be paid in full at the time of order.
If canceled, the deposit is forfeited or a 25% cancellation fee applies to the total purchase price, whichever is greater.
Layaways
All payments made toward a layaway are non-refundable if the layaway is forfeited or canceled after 30 days.
A cancellation fee will be charged on all canceled layaways in accordance with the layaway agreement terms.
5. Critical Steps for Firearm Transfer (Iron Clad Protection)
CRITICAL CUSTOMER OBLIGATION: INSPECT BEFORE YOU ACCEPT
Do not sign the ATF Form 4473 or take physical possession until you have thoroughly inspected the firearm for any cosmetic or functional defects, ensuring it is the correct model, caliber, and configuration.
Once the firearm is transferred into your possession and leaves our store, it is legally considered used. At this point, HavocTech Armory LLC can no longer accept it for return or refund. All post-transfer issues are covered solely by the manufacturer's warranty.
6. Florida & Hillsborough County Compliance
State and Local Preemption
Florida law preempts local governments from regulating the sale of firearms. While Hillsborough County has specific local ordinances, your core refund policy is a matter of business contract. All policies comply with established State and Federal law.
Waiting Periods
Florida State Law
Florida requires a 3-day waiting period for firearm purchases (waived for concealed carry weapon permit holders).

Hillsborough County Ordinance
Hillsborough County requires a 5-day waiting period (120 hours excluding weekends and legal holidays) between the time of sale and the time of delivery of any firearm.
Example: For a handgun transfer initiated on Monday, January 6, 2025:
- Purchase Confirmation: Receipt of purchase establishes the start of the waiting period (January 6, 2025)
- Background Check: NICS background check completed on January 6, 2025
- Waiting Period Calculation: 5-day waiting period covers January 7, 8, 9, 10, and 13, 2025 (excluding weekends)
- Pickup Eligibility: Earliest pickup is Monday, January 13, 2025 (assuming background check approval)

Background Check Failure
Non-Refundable Fees: If a buyer is denied by the background check system (NICS/FDLE), the fee associated with the background check and the restocking fee (20%) are non-refundable. A denied buyer is legally prohibited from possessing the firearm, and the customer is responsible for all associated fees.
Restocking Fees
Restocking fees are necessary in the firearms industry because once a firearm leaves our inventory for transfer, it must be documented and re-transferred if refused, and cannot be resold as new. Our restocking fees reflect industry standards and the administrative burden of reversing firearm transactions.
7. General Shipping Information
Order Processing Time
- All orders are processed within 1 to 3 business days (excluding weekends and holidays) after receiving your order confirmation and, where applicable, the necessary licensing information (e.g., FFL).
- Orders placed after 2:00 PM EST will begin processing the next business day.
Shipping Rates and Delivery Estimates
- Shipping charges for your order will be calculated and displayed at checkout.
- Estimated delivery times are approximations provided by the carrier and do not account for processing time, FFL verification, or unforeseen delays.
- Standard Shipping: 3-7 business days
- Expedited Shipping: 2-3 business days
Carriers and Packaging
- We primarily ship via FedEx, UPS, and USPS for non-firearm products.
- All packages are shipped discretely. The outer packaging will not contain any markings that indicate the contents are firearms, ammunition, or defense articles.
- The return address will use an abbreviated or non-descriptive company name.
- Important: Ammunition and Firearms/Receivers must be shipped in separate packages.
8. Regulated Products and Legal Compliance
Firearms and Receivers (Serialized Items)
Customer Responsibility
It is the customer's sole responsibility to:
- Select a transferring FFL dealer before or during checkout.
- Ensure their chosen FFL sends a legible copy of their current FFL certificate to ffl@havoctech.com referencing the order number.
- Confirm the receiving FFL will accept the transfer.
Shipping Restrictions
- We will only ship the firearm to the address listed on the FFL certificate.
- Handgun Shipping: Handguns will only be shipped via an approved expedited service (e.g., UPS Next Day Air or FedEx Priority Overnight) or as required by the carrier/law.
- Adult Signature Required: All firearm and serialized product shipments will require an Adult Signature upon delivery.
Ammunition
- Shipping Address: Ammunition cannot be shipped to a P.O. Box. A physical street address is required.
- State and Local Bans: Customers are responsible for verifying that the ammunition type and quantity are legal in their jurisdiction. Shipments will be refused to states or localities where prohibited or where additional licensing (e.g., an FFL or Ammunition Permit) is required and not provided.
9. Shipping Restrictions and Exclusions
Prohibited Shipping Locations
We will not ship to:
- P.O. Boxes (except for non-regulated accessories shipped via USPS)
- Freight Forwarding companies for regulated products
- Any international address (see Export Compliance below)
- Any jurisdiction (state, county, city) where the item is legally prohibited
APO/FPO/DPO Shipping
- We comply with all Department of Defense (DoD) regulations for shipping to APO/FPO/DPO addresses.
- Only non-regulated accessories and parts may be shipped. Firearms and ammunition are strictly prohibited.
- Shipments are typically sent via USPS.
10. International Shipping (Export Compliance)
ITAR/EAR
- All items on this website are subject to the U.S. Export Control Laws, including the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR).
- Export is Prohibited: Diversion contrary to U.S. law is prohibited. Export or re-export of any defense article, technical data, or defense service is strictly prohibited without the required government authorization.
- Any customer found to be attempting to circumvent export controls (e.g., shipping to a known freight forwarder for international transit) will have their order cancelled, and they may be banned from future purchases.
11. Lost, Damaged, or Stolen Packages
Damages
If your order arrives damaged, please contact us immediately at service@havoctech.com with photos of the damage and packaging.
Lost/Stolen
We are not responsible for packages that are lost or stolen after the carrier confirms delivery to the provided address (and FFL, where applicable). We recommend adding optional Shipping Insurance at checkout to cover this risk.
Carrier Claims
We will assist the customer in filing a claim with the carrier for insured packages that are lost in transit. Please note that an investigation may take 7 to 14 business days before a resolution is provided.
12. Order Cancellations and Modifications
- Orders may be cancelled or modified within 2 hours of placement by contacting service@havoctech.com.
- Once an order has entered processing or shipping, cancellations or modifications are no longer possible.
- For firearm orders where the FFL has already been notified, cancellation fees (10% of purchase price) may apply.
13. Tracking Your Order
- Once your order ships, you will receive a tracking number via email to the address provided at checkout.
- Tracking information is typically available within 24 hours of shipment.
- For FFL transfers, both the customer and the receiving FFL will receive tracking information.
14. Refused or Undeliverable Packages
- If a package is refused by the recipient or marked as undeliverable, it will be returned to us.
- The customer is responsible for all return shipping costs and will be subject to a restocking fee of 20%.
- For firearms, if the receiving FFL refuses the transfer, the customer must arrange for transfer to an alternate FFL at their expense.
